On August 21, 2025, the Movement Disorders Foundation of Arizona ("MDFA") is conducting a free pickleball event, which will include instruction and active play, at the Center Court Pickleball Club at 7000 E. Mayo Blvd, Scottsdale, AZ (the "Event"). The Event is designed to expose individuals with movement disorders and their caregivers to pickleball. In consideration for my participation in the Event, I agree and consent to the following:
1. I hereby acknowledge and understand that participation in sports and physical activities involves inherent risks of injury. I have no medical condition that would prevent my participation in the Event. I am voluntarily participating in the Event, and I hereby assume full responsibility for any and all risks, injuries or damages that may occur as a result of my participation.
2. I release, waive, discharge and covenant not to sue MDFA, its directors, officers, employees, agents and volunteers from any and all liability for any injury, loss, damage or expense arising from my participation in the Event. This waiver includes, but is not limited to, injuries or damages caused by the negligence of MDFA or its personnel.
3. I agree to indemnify, defend and hold harmless MDFA, its directors, officers, employees, agents and volunteers, from and against any and all claims, damages, losses, costs, liabilities and expenses, including attorneys' fees, due to, rising out of or related in any way to my participation in the Event.
4. I acknowledge that I have carefully read and fully understand this waiver and voluntarily sign it as my own free act and deed. I further agree that this waiver is binding upon my heirs, executors, administrators and assigns.
5. I also acknowledge that photographs and video may be taken of me in my participation in, and attendance at, the Event, and hereby freely agree to allow without restriction all uses of such photos and videos in the reporting and/or promotion of MDFA events, and/or related purposes.
